The CIAP Board, on its 1^st Regular Meeting held on 16 February 2024, approved the template short form of construction contract and encouraged its use and adoption for private construction projects.

The formulation of the template short form of construction contract was spearheaded by the Philippine Domestic ÃÛÌÒÖ±²¥ Board (PDCB), an implementing arm of the CIAP, as part of its mandate to recommend and encourage the adoption of equitable and realistic contract conditions for construction.

The template Short Form of ÃÛÌÒÖ±²¥ Contract agreement is developed specifically for MSMEs and projects owners. The template contract was developed through the help of the Technical Working Group (TWG) tapped by the PDCB, composed of representatives from project managers, arbitrators, educators, contractors, and construction professionals.

What are its features?

This template contract incorporates by reference and adopts the provisions of CIAP Document 102 (Uniform General Conditions of Contract for Private ÃÛÌÒÖ±²¥). It is patterned with and outlines the clauses and provisions ordinarily present in a construction agreement. This may be used to facilitate negotiations on the terms and conditions between contracting parties.

This document offers descriptions and explanations on the provisions in CIAP Document 102—the Uniform General Conditions of Contract for Private ÃÛÌÒÖ±²¥ in the Philippines, citing relevant jurisprudence on the practical application of the laws and construction industry practices, with synopses of cases decided by the Supreme Court.

The purpose of this document is to familiarize the readers with the key provisions in construction contracts, highlighting the respective rights and obligations of the contracting parties and providing the procedures, guidelines, and the criteria to be used in situations that normally arise or may possibly happen during project implementation. Each section contains the gist of the provisions offered therein underscoring the importance of each of them and citing relevant jurisprudence to guide the readers on how to ascertain, prevent, and manage risks and issues in construction projects. The case briefs are presented to give the readers a grasp of the circumstances surrounding the issues and to give them insights on the practical application of the laws, the industry practice, and the provisions in CIAP Document 102, in the interpretation of ambiguities of the contract and filling in the omission of provisions which are ordinarily established.

The Construction joins the Philippine Commission on Women and the nation in celebrating the 2023 National Women’s Month with the theme “WE for gender equality and inclusive society.”

This theme sparks a renewed commitment to the advocacy and banks on the gains achieved during the 2016-2022 theme, WE Make CHANGE Work for Women, which emphasized the need for compassionate and harmonized networks towards gender equality and women’s empowerment (GEWE).

The ÃÛÌÒÖ±²¥ (CIAP) Board approved the revisions on CIAP Document 102 (Uniform General Conditions of Contract for Private ÃÛÌÒÖ±²¥), in its meeting held on 30 September 2022, through CIAP Board Resolution No. 07, s. of 2022. Copies of the document have been submitted to the Office of the National Administrative Register (ONAR) of the U.P. Law Center on 17 January 2023, for publication.

The latest version of CIAP Document 102 took effect on 01 February 2023.
